Tens of millions of Americans might be eligible to claim refunds from the Internal Revenue Service because of a federal-court decision. In Kwong v. United States, the court found that many pandemic-era tax deadlines didn’t actually apply.
The ruling determined that the tax code’s relaxed rules for disaster victims combined with presidential disaster declarations during the Covid-19 pandemic paused many required deadlines between Jan. 20, 2020 and July 10, 2023.
It affects taxpayers who…
1 – Paid penalties for late filing,
2 – Paid interest, or
3 – Failed to make estimated tax payments during the pandemic.
In fiscal 2022 alone, the IRS imposed more than 12 million estimated-tax penalties and an additional 16 million failure-to-pay penalties totaling more than $12 billion. Some of these were abated later.
If you’re eligible for a refund, file your claim using Form 843 by July 10. This form cannot be e-filed. It should be sent Certified Mail. A copy of the form can be found at the following web address…

If you mailed your income tax returns and did not provide the Service with banking information for a federal tax deposit, please remember that as of 2026, the IRS is phasing out paper refund checks, making them rarer due to Executive Order 14247. However, you can still receive a paper check in the following circumstances
If you did not provide direct deposit details (routing and account numbers) on your tax return, the IRS will temporarily freeze your refund and send IRS Notice CP53E. If you receive the notice and do not respond with banking information within 30 days, the IRS will eventually issue a paper check.
Another option is logging into your IRS Online Account to apply for a “hardship” or “access” exception, which may release a check within one to two weeks.
The IRS will still automatically mail a refund check if…
1 – Your direct deposit was rejected by your bank.
2 – You have already received three direct deposits into the same account in a single year
However you decide to handle this, please be patient. The Service doesn’t do anything fast other than ask for your hard earned dollars.
